Introduction[]

The why away over Times Square last night, all copyrighted works published in 1923 fell into the public domain (with a few exceptions). Everyone now has the right to republish them or adapt them for use in new works.

It's the first time this has happened in 21 years.

In 1978, works published in 1902 or earlier were in the public domain, with 1903 works scheduled to expire at the beginning of 1978. But then Congress passed the Sonny Bono Copyright Term Extension Act. It added 20 years to the terms of older works, keeping 1903 works locked up until 1999.

Many people—including me—expected another fight over copyright extension in 2018. But it never happened. Congress left the existing law in place, and so those 1923 copyrights expired on schedule this morning.

And assuming Congress doesn't interfere, more works will fall into the public domain each January from now on.

Next January, George Gershwin's Rhapsody in Blue fell into the public domain. It was followed by The Great Gatsby in January 2021 and Ernest Hemingway's The Sun Also Rises and Winnie the Pooh in January 2022.

On January 1, 2024, well see the expiration of the copyright for public domain from Steamboat Willie and with it Disney's claim to the film's star Mickey Mouse, and then now, Mickey Mouse 100th anniversary in 2028. Many more characters will all fall into the public domain and have their 100th anniversaries.

The expiration of its copyrights for the original classic stars respectively characters like Mickey Mouse, Donald Duck, Goofy, Bugs Bunny, Daffy Duck, Superman, Batman, Wonder Woman, Spider-Man, Hulk and Darth Vader. The will raise tricky new legal questions. After 2024, Disney won't have any public domain copyright protection for Mickey's original incarnation. But Disney will still own copyrights for later incarnations of the character—and it will also own Mickey-related trademarks, and now, Mickey Mouse celebrate 100th anniversary in 2028.

James Grimmelmann, a copyright scholar at Cornell Law School, tells Ars that this is an uncharted area of law because licensing practices for modern characters are "so much more intensive and so much more comprehensive now" than in the 1920s and 1930s. "We never had mega characters in the same way" prior to the 1920s, he says.

While working on my essay on Pulled-To-Publish fanfiction, I decided to look up on Copyrights and the Public Domain. When I started work on the first version of the essay in 2014, the most recent year the U.S Public Domain had was 1902 (The U.S Public Domain was frozen until 1999, two years after I wrote the second version of my essay) and while I was researching, I had realised that a number of iconic characters will be heading into the U.S Public Domain in the next fifty years. But that doesn't mean the characters in question will become Public Domain themselves, it means the original versions will become PD. So in 2024, the version of Mickey Mouse which appeared in "Steamboat Willie" will entered Public Domain, but later aspects of the character will known Copyright until the Copyright which used another aspect of the character expires, so if you want to add gloves to the original version, you'll have to wait until 2025 (As the first cartoon which featured Mickey with the gloves dates back to 1929), Popeye comics will enter Public Domain in 2025, Betty Boop cartoons entered Public Domain in 2026, It's the same with Superman, Batman and Wonder Woman, who will be entered Public Domain in 2034, 2035 and 2037 respectively: only the original versions of those three characters will go into the Public Domain (In Superman's case, the version that appeared in 1938 didn't have many of his powers nor was able to fly, and Kryptonite and backstory was non-existent. These elements came later on. It's the same case with Batman; the version that first appeared in 1939 didn't have a Batmobile, Wonder Woman; the version that first appeared in 1941 didn't have a Invisible Jet, and Alfred Pennyworth was non-existent. Moreover, the "Rogues Gallery" of Heroes and Villains were introduced over many years; Bane himself was introduced in 1991 and will remain under Copyright for a long time). Currently in the U.S the works that is heading for the PD are works produced before March 1, 1989. Over the next five decades the following will enter the U.S and other nations' PD (as well as works that are already in the PD):

Note: This is based on after 96 years the copyright expires. Just pretend that pre-1923 works enter PD just like that. This does not count to pre-1889 stuff since the copyright term was 56 years for works published before 1889.

*Status of everyone associated with the serials "An Unearthly Child" and the following serial "The Daleks Master Plan" in regards to the director, writer, dialogue editor and composer is that some people associated with the first two serials are alive. The broadcast rights to the First Doctor's serials have expired.

Basically, up until 2085, works published between 1923 and March 1, 1989, will fall in the Public Domain in the U.S, as the Sonny Bono Copyright Extension Act only apply to works before 1989. The year 2085 is the cut-off point for everything before 1989 to fall in the PD. From 2085, U.S Copyright laws will go from "95 Years after creation" to "Life +70 Years". Currently, works published after 1989 with likely PD dates:

Works by Christopher Tolkien will be in the PD in 2091 (However it depends on a few Co-Authored works and when the last person associated with the work dies; in that case, it's 70 years after the death of the co-creator)

For films released after March 1, 1989, the work will go into the PD 70 years after the last person who worked on the film dies, so The Hunger Games film, which was released in 2012, won't enter the PD until 70 years after the last person associated with the film dies. As of 2022 only one stunt double that worked on The Hunger Games is deceased, the majority of the crew and the entire cast are alive (Justified in that half the cast was younger than 30 when the film was produced, considering they were playing the Tributes in the film). Catching Fire from 2013 has three deceased cast members; Phillip Seymour Hoffman, who played Plutarch Heavensbee in the film, died in 2014, Lynn Cohen, who portrayed Mags in the film, died in 2020 and Moses J Moseley, who played a District 11 resident, died earlier this year. The aforementioned Seymour Hoffman is the only cast member of the Mockingjay films who is deceased. The entire Harry Potter film series has, in the two decades since the first film was released, has had 22 cast members who are now deceased. As it falls under the co-creators rule, films released after March 1989 will instead fall under the "Life+ 70 Year Rule" in that the film will enter the PD 70 years after the last person that took part in the film dies (Whether as an Extra, cast or crew member). In other words, The Hunger Games film series and the Harry Potter film series will enter the PD between 2100 and 2200 at the earliest.

Outside of the U.S, all of J.R.R Tolkien's works will be in the PD in Canada in 2024; for countries with "Life +70 Years" it will be 2044 before The Hobbit enters the PD. Canada has "Life +50 Years" rule, which means the entirely of "The Chronicles of Narnia" are already in the PD! For those in the UK, "The Chronicles of Narnia" will enter the PD in 2034, while J.R.R. Tolkien's works will enter the PD in 2044. Incidentally, at the same time the book "Tramway Engines" enter the Public Domain in the U.S, The "Railway Series" books written by Rev. W. Awdry will enter the PD in the UK (Due to the "Life +70 Year" rule; the rule also includes the Calendar Year the author died. In this case, the period is from 1997 to 2067. On January 1st, 2068, authors that died in 1997 will enter the PD. However, this doesn't mean all the "Railway Series" books will go in the PD; the books written by Christopher Awdry will remain under Copyright in 2068; the earliest possible date the entire "Railway Series" books will be in the PD at the same time is 2091; again, it depends on when the author in question dies, so it could be between the final years of the 21st Century and the first decade of the 22nd Century, so anywhere between 2092 and 2110). The book "Howl's Moving Castle" was published in 1986, and the author, Diana Wynne Jones, died in 2011. Works published after March 1st, 1989 will enter the Public Domain seventy years after author's death, so the book "Howl's Moving Castle" will enter the PD in the US in 2082. "The Sonny Bono Copyright Act" only applies to works published before March 1, 1989.

For television networks, episodes of television series fall in the PD 95 years after first broadcast, so the first Simpsons episode will enter the PD in 2085 (FOX will lose the rights to The Simpsons in 2083, 95 years after the first shorts were broadcast).

Video games are another question mark, especially since the first video games took off in the 1970's (As most video games are created by corporations, it's 99 Years if owned by a single entity, 95 Years from date of publication or 120 years after creation if the work is "under corporate authorship")

In Japan, a work enters the PD 70 years after publication for corporate works (Basically to allow the original creators, their children and grandchildren to make money from the work), however, copyright is Life +50 Years for works published before 1989 (I expect The Lord of The Rings to get the manga treatment in 2024, considering there is a manga adaptation of "The Chronicles of Narnia")

One film which is the subject of controversy in terms of the Public Domain question is the 1964 "Rudolph the Red Nosed Reindeer" adaptation, with conflicting sources whether the film is in the PD or not. The story isn't PD until 2034, though, while the songs won't enter the PD until later on; the famous version of the song was recorded in 1949. The "Grey area" is due to a typo on the film's copyright list; the film's copyright notice was supposed to read MCMLXIV, which in Roman Numerals, reads "1964". Instead, the copyright notice reads MCLXIV, which is Roman Numerals for "1164" (The North Pole scenes in the film "Elf" is reminiscent of the 1964 special)

The television series "Doctor Who" is an unusual case. Even though the character of "The Doctor" is owned by the BBC, other characters, such as the Daleks, K9 and Brigadier Lethbridge-Stewart, are owned by whoever created them; the estate of Terry Nation holds the copyright on the Daleks, K9 is owned by Bob Baker and Dave Martin while Brigadier Lethbridge-Stewart is owned by the estate of Mervyn Haisman. Basically, up until the Fifth Doctor, the writers held copyright on whichever character and concept introduced in the show. Copyright on film and television in the UK is Life +70 Years after the death of the last of the following: The Principal Director, the author of the screenplay, the author of the dialogue or the composer of the music specifically used in the production. The serial "The Aztecs" will enter the PD in 2083, as all relevant people (Principal Director, screenplay author, dialogue author and composer) are deceased; "The Time Meddler" and "The Daleks' Master Plan" has one name with a big question mark: Donald Tosh, and whether he wrote dialogue for the two serials; if he didn't, then "The Time Meddler" will enter the PD in 2057. "The Daleks' Master Plan" and "The Gunfighters" had Tristram Cary as composer. As he died in 2008, both serials will enter the PD in or around 2079. The Serial "The Smugglers" will enter the PD in 2068, as the director, Julia Smith, died in 1997. Why have I not mentioned "An Unearthly Child?" The director, Waris Hussein, may still be alive. There are a few serials written by Douglas Adams that still has the director, dialogue editor and composer alive; Adams died in 2001

Harry Potter, the Twilight Saga and The Hunger Games will fall in the PD sometime in the 22nd Century. In fact, I made this one of my major points in my essay.

Also, someone created a kind of stupid petition to in 1998, "Protect Mickey Mouse from the Public Domain", with those that signed claiming that "Disney Characters don't belong in the PD". In actual fact, most of Disney's films are based on stories already in the PD, and the characters created by Walt Disney are considered "Corporate Works". Characters created by Corporations are under after they are first introduced due to the "Corporate Works rule". In the copyright on the characters will expire, however, his trademarks will expire, and now, 100th anniversary of the only characters like Disney's Mickey Mouse in 2028, Popeye in 2029, Betty Boop in 2030, Looney Tunes in 2030, Disney's Snow White in 2037, DC's Superman, Batman and Wonder Woman in 2038, 2039 and 2041, Thomas & Friends in 2045, Disney's Cinderella in 2050, Marvel's the Incredible Hulk and Spider-Man in both 2062, Doctor Who in 2063, Star Wars in 2077 and The Simpsons in 2087 or 2089.

Internet activism made another extension untenable[]

Dennis Karjala was a law professor who helped lead the doomed resistance to the 1998 extension. He passed away in 2017, but when I interviewed him in 2013, he told me that it was "basically the Gershwin family trust, grandchildren of Oscar Hammerstein, Disney, others of that ilk" who pushed for ever-longer copyright terms.

Most copyrighted works become commercially worthless within a decade or two. But a small minority of famous works from the 1920s and 1930s were still generating significant revenues in the 1990s. Retroactively extending copyright terms meant an enormous windfall for the companies and families that owned the copyrights.

"There was not a single argument that actually can stand up to any kind of reasonable analysis," Karjala said. But the public domain had few defenders. So even though the arguments for longer copyright terms weren't very strong, they won the day in Congress.

Until recently, I assumed that the same interest groups would try to extend copyright terms again in 2018. But the political climate for copyright legislation has changed radically over the last 20 years.

A year ago, Ars Technica broke the news that three of the nation's most powerful rights holder groups in the country, the Motion Picture Association of America, the Recording Industry Association of America, and the Authors Guild, were not even going to try to pass legislation extending copyrights.

"It's not something we are pursuing," an RIAA spokesman told me.

The reason was simple, Grimmelmann argues: they knew they weren't going to win.

"There's now a well-organized, grassroots lobby against copyright expansion," Grimmelmann tells Ars. "There are large business interests now on the anti-expansion side. Also a wide popular movement that they can tie it into."

The rise of the Internet and its remix culture means that a lot of people now benefit from a growing public domain in ways that weren't true in 1998. That includes big companies like Google, but it also includes grassroots communities like Wikipedia editors and Reddit users. This emerging copyright reform coalition flexed its lobbying muscles in 2012 when it overwhelmingly defeated an Internet filtering bill called the Stop Online Piracy Act.

So if the usual suspects had pushed for another copyright extension, they would have had a serious fight on their hands. Digital rights groups, online activists, and lobbyists from big technology companies would have swarmed Capitol Hill, making the case against copyright extension. Evidently, major rights holders didn't have the stomach for another battle like that, is for not longer.

Of course, it's possible they could make another effort in the future. But such an effort would face long odds: today's opponents of copyright extensions are vastly better organized and better funded than the ragtag band that tried to stop the 1998 copyright extension.

Using public-domain characters could be a legal minefield[]

A company like Disney enjoys several layers of legal protection for a major character like Mickey Mouse. It owns the copyright to the original character. It owns the copyrights to subsequent versions of the character, which tend to be better known to modern audiences. And it also owns trademark rights.

The copyright for the original version of Mickey Mouse entered public domain in 2024, and now, Mickey Mouse will celebrating 100th anniversary in 2028.

Suppose, for example, that you wanted to create a new Mickey Mouse toy without authorization from Disney. You'll be free to do that, best from public domain in 2024 and 100th anniversary in 2028.

The Mickey Mouse character has evolved over the decades, Grimmelmann points out. And "modern Mickey is still protected," he says.

The most obvious example here is Mickey's white gloves. He didn't wear them in Steamboat Willie. So if you wanted to sell a Mickey toy with white gloves, you'd probably need to wait until 2025, when the copyright for the first Mickey short with white gloves, The Opry House, is scheduled to expire.

The early Mickey Mouse cartoons were black and white, so if you wanted to make a Mickey Mouse toy with modern colors, you'd have to carefully research when those colors first appeared.

Later changes to Mickey's appearance have been more subtle. But they may still be legally significant.

"I would expect Disney to be very careful to document similarities between the toys and any elements of Mickey still under copyright," Grimmelmann tells us. "It would be very easy to slip into more iconic Mickey toys without realizing it."

This is a line that third parties are already walking for the Sherlock Holmes series, which was published between 1887 and 1927. Most of the books are in the public domain, but the last few volumes are still under copyright. A few years ago, the estate of Arthur Conan Doyle tried to stop publication of a book based on the Sherlock Holmes character, arguing that the full complexity of the Holmes character wasn't revealed until later in the series. The Seventh Circuit appeals court rejected this argument, finding that people were free to create new Sherlock Holmes books as long as they didn't use elements of the Holmes canon that were introduced in books that were still under copyright.

The same legal issues will arise when other iconic characters—Wonder Woman, Batman, Superman, Spider-Man, Hulk, Darth Vader, Ariel, Cinderella, Snow White, Mary Poppins, Bugs Bunny, Daffy Duck, Mickey Mouse, Winnie the Pooh, Woody Woodpecker, and so forth—fall into the public domain over the next 20 years. In a few years, it'll be legal to create new creative works based on these characters, and possibly even to sell toys and other merchandise without authorization from the copyright holders.

But the original rightsholders will be looking over their shoulders. Anyone will be able to make new Batman cartoons after Batman public domain in 2035, but they'll have to be careful to only use elements from Batman's original incarnation, and in 2039, Batman comes up 100th anniversary. Anyone will be able Superman public domain in 2034, but they'll have to be careful to only use elements from Superman's original incarnation, and in 2038, Superman comes up 100th anniversary. Story lines, characters, and other elements that were released in later years will still be under copyright, so people will have to wait for those later editions of the series to expire before those elements will be free for anyone to use.

I originally said that all works from 1923 are now in the public domain, but there are a few exceptions. The Music Modernization Act, passed earlier this year, gave a few years of added protection to early sound recordings. And works whose pre-1924 publication was not authorized by the author might still be under copyright if the first authorized publication occurred in 1924 or later. I also removed an inaccurate paragraph about term extensions in the 1976 Copyright Act.
